County Mayor’s Notes – September 16th, 2019

The September 16th meeting of the full County Commission was held with all Commissioners in attendance except Nancy Hyder.

The first item of business was a motion to give me the authority to resolve the Blackwood legal case.  The motion was approved unanimously.  Next, the election of the Chairman for the next year was held.  Commissioner York nominated me to be the chairman for the next year and Commissioner Seiber seconded the nomination.  With no other nominations made, the commissioners elected me as the Commission Chair for the next year.  Commissioner Stone was elected as the Chairman Pro-Tem and Commissioner Hyder was elected as the Parliamentarian.  All were unanimous selections.

RESOLUTIONS
The following resolutions were approved (resolution sponsor in parenthesis):

RESOLUTION 09-2019-1 – A resolution to appoint a Judicial Commissioner for Cumberland County, Tennessee (Gibson).  General Sessions Judge Larry Warner and Len Blevins nominated Pamela Waltenberg as a Judicial Commissioner for a one-year term as this is her initial appointment.  The resolution approved 17-0.

RESOLUTION 09-2019-2 – A resolution to appoint members to the Ethics Committee (Foster).  Deborah Holbrook, Rick Williams, Josh Stone, Jill Davis, and Valerie Cox were appointed as members of the Ethics Committee for one-year terms.  The resolution was approved unanimously.

RESOLUTION 09-2019-3 – A resolution to re-appoint a member to the Cumberland County “E-911” Emergency Communications District Board of Directors (Foster).  Everett Bolin and David Hassler were unanimously reappointed to the E-911 Emergency Communications District Board for a term of one year.  The terms are usually longer but the appointment schedule had gotten off schedule.  At the request of Chairman Bolin and the E-911 attorney, the appointments are for one year to get the terms properly aligned again.

RESOLUTION 09-2019-4 – A resolution to reappoint members to the Financial Management/Purchasing Committee (Foster).  Nancy Hyder, Charles Seiber, Jack Davis, and John Patterson were reappointed to the Financial Management Committee in a 17-0 vote.

RESOLUTION 09-2019-5 – A resolution to rescind resolution #807-2 regarding the Cumberland Regional Habitat Conservation Plan (K. Davis).  Resolution 807-2 was adopted August 2, 2007 concerning the development of a plan for the Obed and Caney Fork watersheds.  The plan no longer addresses the watersheds and has been changed to focus on several bat species.  Tonight’s resolution rescinded Resolution 807-2 and rejected the new plan as presented to the Environmental Committee on August 15, 2019.  The resolution was approved 16-1 with Commissioner Holbrook voting against.

RESOLUTION 09-2019-6 – A resolution to amend the contract between the State of Tennessee, Department of Mental Health and Cumberland County, Tennessee (Foster).  The prior contract for payment for mental health evaluation and treatment services for criminal defendants charged with misdemeanors had expired.  This contract set the same rate and terms as the previous year and was approved unanimously.

RESOLUTION 09-2019-7 – A resolution to release county owned right-of-way to property owner on Hyder Loop (K. Davis).  All of the adjacent property owners agreed to release the right-of-way and accept the costs involved.  The Cumberland County Planning Commission and the Environmental Services Committee reviewed the request and agreed to release the right-of-way as well.  The resolution was approved 17-0.

RESOLUTION 09-2019-8 – A resolution to release county owned right-of-way to property owner – Hidden Drive (K. Davis).  All of the adjacent property owners agreed to release the right-of-way and accept the costs involved.  The Cumberland County Planning Commission and the Environmental Services Committee reviewed the request and agreed to release the right-of-way as well.  The resolution was approved unanimously.

RESOLUTION 09-2019-9 – Budget Amendment, Property Assessor, $1,550.00 (Cooper).  A Property Assessor Deputy position was reviewed by Organization Management Group and a determination was made that the position should be reclassified due to changes in the job description.  This resulted in a recommended pay increase.  The resolution was approved 17-0.

RESOLUTION 09-2019-10 – Budget Amendment, Drug Control Fund, $3,600.00 (Wilson).  This budget amendment to purchase camera for patrol deputies for use in drug control and eradication was approved unanimously.  The money will come from the unassigned fund balance in the Sheriff’s Department Drug Enforcement budget.

RESOLUTION 09-2019-11 – Budget Amendment, Emergency Management Agency, $5,300.00 (Wilson).  This resolution accepted funds for a 100% grant for equipment acquisition and upgrades at the EMA.  The resolution was approved 17-0.

RESOLUTION 09-2019-12 – Education Capital Projects Fund, Crab Orchard Elementary School Building and Renovation Program, $234,968.53 (Stone).  There is an excess of funds on the Crab Orchard School project.  The BOE would like to use those funds to do road work, as well as roof repairs and other work to improve the “new” part of the building that was kept.  The resolution was approved unanimously.

RESOLUTION 09-2019-13 – A resolution to accept offer from Jessica Garcia to purchase property owned by Cumberland County (Hyder).  The Delinquent Tax Committee recommended an offer of $256.40 plus a $45 advertising fee for the purchase of one parcel.  This will return the property to the tax rolls after it had been removed due to property taxes not being paid for several years.  The resolution was approved 17-0.

RESOLUTION 09-2019-14 – A resolution to accept offer from Jessica Garcia to purchase property owned by Cumberland County (Hyder).  The Delinquent Tax Committee recommended an offer of $256.40 plus a $45 advertising fee for the purchase of one parcel.  This will return the property to the tax rolls after it had been removed due to property taxes not being paid for several years.  The resolution was approved unanimously.

RESOLUTION 09-2019-15 – A resolution to accept offer from Stephanie Clark to purchase property owned by Cumberland County (Hyder).  The Delinquent Tax Committee recommended an offer of $323.40 plus a $45 advertising fee for the purchase of one parcel.  This will return the property to the tax rolls after it had been removed due to property taxes not being paid for several years.  The resolution was approved 17-0.

RESOLUTION 09-2019-16 – A resolution to accept offer from Dustin Swallows to purchase property owned by Cumberland County (Hyder).  The Delinquent Tax Committee recommended an offer of $278.40 plus a $45 advertising fee for the purchase of one parcel.  This will return the property to the tax rolls after it had been removed due to property taxes not being paid for several years.  The resolution was approved unanimously.

RESOLUTION 09-2019-17 – A resolution to accept offer from Timothy F. Child to purchase property owned by Cumberland County (Hyder). The Delinquent Tax Committee recommended an offer of $252.90 plus a $45 advertising fee for the purchase of one parcel.  This will return the property to the tax rolls after it had been removed due to property taxes not being paid for several years.  The resolution was approved 17-0.

RESOLUTION 09-2019-18 – A resolution to accept offer from Micheal Matthews to purchase property owned by Cumberland County (Hyder).  The Delinquent Tax Committee recommended an offer of $271.90 plus a $45 advertising fee for the purchase of one parcel.  This will return the property to the tax rolls after it had been removed due to property taxes not being paid for several years.  The resolution was approved unanimously.

RESOLUTION 09-2019-19 – A resolution to accept offer from Jeff Conner to purchase property owned by Cumberland County (Hyder).  The Delinquent Tax Committee recommended an offer of $287.00 plus a $45 advertising fee for the purchase of one parcel.  This will return the property to the tax rolls after it had been removed due to property taxes not being paid for several years.  The resolution was approved 17-0.

RESOLUTION 09-2019-20 – A resolution to accept offer from Jeff Conner to purchase property owned by Cumberland County (Hyder).  The Delinquent Tax Committee recommended an offer of $279.80 plus a $45 advertising fee for the purchase of one parcel.  This will return the property to the tax rolls after it had been removed due to property taxes not being paid for several years.  The resolution was approved unanimously.

RESOLUTION 09-2019-21 – A resolution to accept offer from Micheal Matthews to purchase property owned by Cumberland County (Hyder).  The Delinquent Tax Committee recommended an offer of $264.00 plus a $45 advertising fee for the purchase of one parcel.  This will return the property to the tax rolls after it had been removed due to property taxes not being paid for several years.  The resolution was approved 17-0.

FINANCIAL REPORT
Local option sales tax collections came in at $870,571 which is $5,441 below estimated revenue for the first month of the new budget year.  Hotel/Motel tax collections are approximately 11% of budget.  As it is so early in the year, we have no numbers for Property tax or prisoner boarding.  EMS collections for the year are down approximately $51,340 against budgeted income at $615,326.  This is due to the Medicare revalidation process that was just completed that causes some bills to be resubmitted.  Those bill have been resubmitted and the revenue should start coming in again.

This Saturday, 9/21 from 11 AM until 2 PM, the Mayland Senior Center will be having a fundraiser.  There will be live music and great food for $6 per plate.  The event is at 36 Ballfield Drive and is hosted by Commissioner Mark Baldwin.  Come get some BBQ, mac-n-cheese, coleslaw, baked beans, chips, sweet tea and water with a variety of desserts!
